Yardsaledb.com is a free garage sale advertisement service where you can freely post garage sales that you are hosting and search locations of garage sales in and around supplied zipcode . Yardsaledb.com is owned and maintained by the same owner of Listadeyo.com. You understand and agree that the Service may include content-targeted ads or other related information, as further described below and in the Privacy Policy. In addition, you understand and agree that the Service is provided on an AS IS and AS AVAILABLE basis. Yardsaledb.com disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Service. Yardsaledb.com also reserves the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you. # Personal Use. The Service is made available to you for your personal use only. You agree to post only relevant postings regarding to yard sales or garage sales. You agree that you are responsible for your own sales posting and for any consequences thereof. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. Yardsaledb.com is not responsible for the correctness of the sale postings and you must use it at your own discretion knowing that other users might post fake sales as tricks or malicious jokes. Yardsaledb.com will not be responsible or liable for the exercise or non- exercise of its rights under this Agreement. # Intellectual Property Rights. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service. Your Intellectual Property Rights. Yardsaledb.com does not claim any ownership in any of the content, including any text, data, information, images, photographs, music, sound, video, or other material, that you upload, transmit or store in your postingt. We will not use any of your content for any purpose except to provide you with the Service. # Representations and Warranties. You represent and warrant that (a) all of the information provided by you to Yardsaledb.com to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder. # Privacy. As consideration for using the Service, you agree and understand that Yardsaledb.com will display ads and other information adjacent to and related to the content of the website. No human will read the content of your posting in order to target such advertisements or other information without your consent, and no posting content or other personally identifiable information will be provided to advertisers as part of the Service. # Posting Duration. After the sale date that you have indicated on your sales posting has occurred, your posting will be removed from the Service due to its past-date. Each day at 3:00am PST the sales posting that advertise sales that have occurred in the previous day will be deleted. # Termination; Cancellation. You may remove your posting at any time on or before the date of sale. Simple follow links to do so. There is no obligation to hold the posting for any duration of the time and there is no oligation to cancel at any time. # Indemnification. You agree to hold harmless and indemnify Yardsaledb.com, and its subsidiaries, affiliates, officers, agents, and employees from and against any third party claim arising from or in any way related to your use of the Service, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Yardsaledb.com will provide you with written notice of such claim, suit or action. # Choice of Law; Jurisdiction. These Terms of Use will be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflict of laws provisions or your actual state or country of residence. Any claims, legal proceeding or litigation arising in connection with the Service will be brought solely in Orange County, California, and you consent to the jurisdiction of such courts.
